The five fundamental rights of a tenant


1. Negotiate the rental and contract periods: Under the newly amended Spanish Urban Leasing (Ley de Arrendamientos Urbanos), you are entitled to terminate your lease 6 months after signature, even if you are signing for a year, so long as you notify the owner at least 30 days in advance. In parallel, the lease may be extended annually for three years unless the landlord (or his spouse or blood first-grade relatives) needs the property permanently to live there, in which case he can kick you out.


2. First in line to purchase the apartment: As a tenant, you prefer to buy the property if the landlord decides to put it for sale. However, they may also include a clause in the rental contract stating that this rule is excluded.


3. Ask the landlord for repair: you also have the right as a tenant to request the property owner to repair anything needed to keep the dwelling habitable. However, beware: the owner cannot be held responsible for the damage caused by daily house use or the breakdown caused by misuse.


4. Report the landlord if you enter a property without permission: this is particularly important because the landlord can only enter the property if he has your express permission. If they break this rule and enter without asking, you may report that they have violated your privacy.


5. Get back your deposit when you leave: as long as the building is in good condition and no outstanding payments left, tenants are entitled to retrieve their deposit they paid at the start of the rent.


The five fundamental obligations of a tenant


1. Pay a deposit: you must pay a down payment as insurance to the landlord for damages before you start living at your new student home. The amount to be paid is generally equal to one month's rent.


2. Every month pay the rent: the tenant must pay the rental contract on a monthly basis. Payment must be made during the first 7 days of the month (unless otherwise agreed) in the place and manner agreed by both parties. The most common thing is that the payment is made by bank transfer and you don't have to give cash if you prefer.


3. Leaving the property in the same condition as you did: you also have a duty to leave the house in the same conditions when you started living there, when renting student homes. If not, you may lose your deposit as the landlord keeps it covering any cleaning or repair charges.


4. Discuss any necessary repairs to the owner: the property owner shall be notified of any repairs that must be carried out to preserve the habitability of the property. This duty also adds the weight to allow the owner and any other personnel that may be required to enter the house to make reparations.


5. Do not perform dangerous works or activities: keep in mind that works that may cause instability or insecurity in the home are not allowed to be performed yourselves. If something needs to be done, cover your own back and ask the owner to do it for you. There may not be any illegal, harmful or dangerous activities or disturbances on the property in the same way (and obviously).
