It is again time for taxpayers in Spain to consult their tax data online or through the Spanish tax office's Agencia Tributaria app. The annual tax return for residents of Spain, known as the "declaration of income," deals with Spain's income tax equivalent known as the IRPF – Income Tax for Physical Persons. The campaign began this year on 1 April 2020 and all 2019 revenue tax returns have to be submitted by 30 June 2020.

The 2019 income tax campaign is rather unusual, however, as the expansion of coronavirus in Spain began in the middle of that confined period. Therefore, in the face of these exceptional circumstances, tax consultants receive more doubts than usual in taxpayers' cases, with particular concerns that if the status of alarm means that individuals cannot submit their tax declarations, they will be able to pay later than usual, or how matters are impacted if an ERTE (temporary lay-off) was issued in recent weeks. The campaign is currently up and running on the original dates of 1 April - 30 June 2020. It was however stated that if the current state of alarm continues to be extended into May or even June, the possibility of extension may exist by September.

Can I still appoint and go to the tax office?

The official calendar allows appointments to file your tax return in the "Agencia Tributaria" office, starting on 7 May 2020, with those appointments in person starting on 13 May. However, as part of the alarm in Spain, these tax offices are currently closed, and it is not yet known whether or not there will be changes to face-to-face appointments following the COVID-19 outbreak.

If I don't know how to change the draft now, what should I do?

In that case, the advice is to place yourself in the hands of professionals (a financial agency or consultancy), who will guide you on the distance and telematically file your tax returns. They will also inform you of the latest advice and possible changes during the campaign.

What do I do if I have an ERTE given in the last few weeks?

The ERTE, a temporary entitlement, will not affect the tax return this year as you will be filing your taxes for the fiscal year 2019. An ERTE in 2020 will affect your tax return next year.

The Agencia Tributaria also stated that taxpayers should not stop filing their taxes due to the current situation. You should not delay if you are able to review your draft online and confirm your details. Note that not everyone is required to submit a statement. Those who received revenue of EUR 22,000 last year and only have one payer are excluded. If the income is generated by more than one payer, the exclusive limit shall be EUR 14,000.
